• These Terms and Conditions (“Terms”) govern your access to and use of the Website and your engagement with any real estate brokerage, advisory, or related services we provide (“Services”). By accessing the Website, submitting an inquiry, or engaging our Services, you (“you,” “User,” or “Client”) confirm that you have read, understood, and agree to be bound by these Terms. • Falcon Premier is a licensed real estate brokerage operating under the regulatory framework of the Real Estate Regulatory Agency (“RERA”), an arm of the Dubai Land Department (“DLD”), and the Dubai Department of Economy and Tourism.

3. Our Services

• Falcon Premier acts as a real estate brokerage and advisory firm, connecting buyers, sellers, landlords, and tenants with residential and commercial properties across the UAE. We maintain working relationships with more than 100 developers across the UAE, and our services may include the following:
• Marketing and listing of primary (off-plan) and secondary (ready) properties on behalf of developers, owners, and landlords;
• Advisory and matchmaking services for buyers, tenants, and investors;
• Facilitating introductions, viewings, and communications between parties to a potential transaction;
• General market information and area guides published on the Website.
• Falcon Premier acts as an intermediary/agent and, unless otherwise agreed in a signed brokerage or agency agreement, is not a party to any sale, purchase, or lease contract concluded between a buyer/tenant and a seller/landlord/developer.

4. Eligibility and Use of the Website

• You may use the Website only for lawful purposes and in accordance with these Terms. By using the Website, you confirm that you are at least 18 years of age and have the legal capacity to enter into binding agreements. You agree not to:
• Use the Website in any way that violates applicable UAE federal or Dubai local law;
• Scrape, copy, or republish listings, images, or content from the Website without our prior written consent;
• Attempt to gain unauthorized access to any part of the Website, our systems, or related accounts;
• Submit false, misleading, or fraudulent information through any enquiry form, WhatsApp channel, or other communication method;
• Use automated means (bots, crawlers) to interact with the Website without authorization.
• We reserve the right to suspend or terminate access to the Website for any User who breaches these Terms.

5. Property Listings and Accuracy of Information

• Property listings, prices, floor plans, availability, developer information, payment plans, and images published on the Website are provided for general informational purposes and are sourced, in part, from developers, property owners, landlords, and other third parties.

• While we take reasonable care to keep listing information accurate and up to date, Falcon Premier does not warrant or guarantee the accuracy, completeness, or currency of any listing. Prices, availability, specifications, and payment plans are subject to change by the relevant developer or owner without notice, and images (including renders and floor plans) may differ from the actual unit or building on completion. You should independently verify all material details — including price, availability, title, and specifications — with Falcon Premier or the relevant developer/owner before making any decision.

6. No Investment, Financial, or Legal Advice

• Content on the Website, including market commentary, area guides, and blog articles, is provided for general information only and does not constitute investment, financial, tax, or legal advice. Real estate investment carries inherent risk, including fluctuations in property value and rental yield. You should obtain independent professional advice (financial, legal, and/or tax) before making any property purchase, investment, or leasing decision. Any transaction you enter into based on information obtained through the Website or our Services is undertaken at your own discretion and risk.

7. Developer and Third-Party Relationships

• Falcon Premier markets and introduces properties developed, owned, or managed by third-party developers and property owners, including major UAE developers, under commercial arrangements between Falcon Premier and those parties. These arrangements do not make Falcon Premier a guarantor of a developer’s or owner’s obligations. Falcon Premier is not responsible or liable for:
• Construction quality, project delays, handover timelines, or completion of any development;
• A developer’s or landlord’s compliance with its own contractual, statutory, or RERA/DLD obligations;
• Any dispute arising directly between you and a developer, owner, landlord, or tenant.
• Any off-plan purchase should be registered with the Dubai Land Department’s Oqood system (or the applicable emirate’s equivalent) in accordance with UAE law, and you are encouraged to confirm a project’s registration status directly with RERA/DLD before committing funds.

8. Brokerage Fees and Commission

• Where Falcon Premier acts as your appointed broker or agent, applicable commission, fees, and payment terms will be set out separately in a signed brokerage agreement, tenancy agreement, or written confirmation between you and Falcon Premier, consistent with the fee structures permitted under RERA regulations. Nothing on the Website constitutes an offer or agreement as to fees unless confirmed in writing.

9. Enquiries and Communications

• By submitting an enquiry form, WhatsApp message, phone call, or email to Falcon Premier, you consent to being contacted by our team regarding your enquiry and, where you have opted in, regarding relevant property updates and marketing communications. You may opt out of marketing communications at any time by contacting info@falconpremier.ae. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.

10. Intellectual Property

• All content on the Website — including text, graphics, logos, property images, floor plans we have produced, and the Website’s design and layout — is owned by or licensed to Falcon Premier and is protected by UAE and international intellectual property laws. You may view and share Website content for personal, non-commercial use, but may not reproduce, distribute, or exploit it commercially without our prior written consent. Developer logos, renders, and brand assets remain the property of the respective developers and are used with permission for marketing purposes.

11. Third-Party Links

• The Website may contain links to third-party websites, including developer websites and social media platforms. These links are provided for convenience only. Falcon Premier does not control and is not responsible for the content, accuracy, or privacy practices of any third-party website, and inclusion of a link does not imply endorsement.

12. Limitation of Liability

• To the fullest extent permitted under UAE law, Falcon Premier, its directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the Website or reliance on any information published on it, including but not limited to loss of profit, loss of investment value, or loss arising from a third-party developer’s or landlord’s default. Nothing in these Terms limits liability that cannot lawfully be excluded under UAE law.

13. Indemnification

• You agree to indemnify and hold Falcon Premier harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Website, or your violation of any applicable law.

14. Governing Law and Jurisdiction

• These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the competent courts of Dubai, without prejudice to any right Falcon Premier may have to refer a matter to RERA or the Rental Disputes Settlement Centre where applicable.

• We may update these Terms from time to time to reflect changes in our Services, business practices, or applicable regulation.
